Terms and conditions

Western District Health Service ABN 47 616 976 917 (National Centre for Farmer Health, we, us or our) wants you to participate in and contribute to, the Farmer Health website. However there are some rules that need to be respected and understood.

 

Respect

National Centre for Farmer Health (NCFH) understand that people have different views on a range of topics, however NCFH expect everyone who uses the NCFH website to treat each other with respect and courtesy.

 

Use of forums and other interactive services

NCFH welcome your contributions, but you must accept the following terms and conditions, which apply in all cases where you contribute any type of comment, pictures, stories or any other content. NCFH may change the Farmer Health Terms and Conditions from time to time, at our sole discretion.

 

User views are not our views

NCFH do not endorse the views or material contained in users’ comments, posts or other contributions.

 

  1. Registration and login details

1.1 To submit content or to use certain NCFH services, you may be required register and establish an account with NCFH.

1.2 Any comments or other submissions that you post on the NCFH website can remain online indefinitely and may be found through search engines or online archives.

1.3 When you register, a genuine email address must be provided, and this will be verified. In some cases, you may be asked to provide your real name or other identifying or contact details, such as where content is submitted for use in a ‘personal story’ or an event is submitted to the ‘Community calendar’. In some cases, for example in forums, you will have the option to use a ‘log in name’ or pseudonym (ie. not your real name).

1.4 Consent is required from a parent or guardian before a child can register with, or submit content to, any interactive service.

1.5 NCFH may refuse any users who attempt to register using login names considered inappropriate, this decision is solely at our discretion.

1.6 You must not impersonate another living person or registered user.

  1. Passwords and security

2.1 As a registered user of the NCFH website, you may receive or establish one or more passwords. You are responsible for maintaining the confidentiality and security of your password(s).

2.2 Accordingly, you understand and agree you are fully responsible for all actions and submissions made from your account.

2.3 If you become aware of any unauthorised use of your account, you should notify NCFH immediately.

 

  1. Termination of your account

3.1. You can close your NCFH account at any time by unsubscribing, where that option is available to you, or by notifying NCFH. You should note, however, that your contributions may still be available on the NCFH website and associated services after your account has been closed.

3.2 If we reasonably believe you have breached these Terms and Conditions, NCFH reserve the right to restrict access to, or terminate your account, with or without notice, and without incurring any liability to you.

 

  1. User participation

4.1 Children’s contributions should be supervised by an adult.

4.2 You may be held legally responsible for the content you submit to NCFH interactive services.

4.3 All material published on the NCFH website is at our sole discretion.

4.4 All contributions may be moderated and edited if deemed necessary by NCFH.

4.5 Your contribution may be removed or not published if NCFH consider it to be:4.5.1 defamatory or otherwise unlawful or in violation of laws regarding harassment, discrimination, racial vilification, privacy or contempt;

4.5.2 intentionally false or misleading;

4.5.3 an infringement of intellectual property rights. See below for further information on intellectual property;

4.5.4 abusive, offensive or obscene;

4.5.5 inappropriate, off topic, repetitive or vexatious.

4.6 Your contribution may also be removed or not published if NCFH consider that it:

4..6.1 compromises the privacy of other contributors, NCFH staff, or contains inappropriate personal information;

4.6.2 endorses commercial products or activities or promotes commercial products or services;

4.6.3 seeks to directly solicit donations;

4.6.4 deliberately provokes other community members;

4.6.5 is posted on behalf of a suspended member. This may lead to your membership being locked or terminated.

4.7 Repeated breaches of the NCFH Terms and Conditions may cause NCFH to complain to the Internet Service Provider of the person responsible, and in very serious cases, initiate legal action.

4.8 NCFH reserve the right to archive and republish all contributions to our interactive services across all platforms.

4.9 NCFH reserve the right to use contributions for internal training purposes.

  1. Medical disclaimer

5.1 While the information on the NCFH website has been researched, reviewed and presented with all due care, the content is provided for general education and information only.

5.2 Information on the NCFH website is not intended to replace medical advice from a health professional.

5.3 NCFH do not accept any liability for any error or omission, injury, expense, loss or damage incurred by you, or another party, as a result of you using or relying on any information contained on the NCFH website or any linked website.

5.4 All users are urged to seek advice from a qualified health care professional for diagnosis, treatment and answers to their medical questions.

6.1 NCFH have used reasonable endeavours to ensure that material contained on the NCFH website is correct at the time the relevant page is created, modified and published.

6.2 However, NCFH give no warranty and accept no responsibility for the accuracy or the completeness of the material and reserve the right at any time to make changes as we deem appropriate.

6.3 NCFH provide external links as a service to users of the NCFH website. In providing an external link NCFH do not accept responsibility for or endorse the content or condition of any linked website.

6.4 NCFH are not in any way liable for the accuracy of any information printed and stored by a user nor are NCFH liable for the accuracy of information posted by users to our forums.

7.1 NCFH publish links to external sites at our sole discretion, including links posted by users, which are subject to moderation.

7.2 NCFH are not responsible for, and do not endorse, the content on external sites.

7.3 It is the responsibility of the user to make their own decisions about the accuracy, currency, reliability and correctness of information contained in linked external websites.

7.4 NCFH reserve the right to remove user-posted links for any reason, at any time, with or without notice to the user.

8.1 Unless expressly stated otherwise, NCFH are the sole owner of all the copyright, trade marks, trade names, patents and other intellectual property rights created, developed, subsisting or used in or in connection with the NCFH website, whether or not you contribute to such material.

8.2 The information is provided for non-commercial electronic viewing by individuals or organisations only. Any third party information or content contained within the NCFH website is the property of its respective owners. No part may be reproduced by any process, except as permitted under the applicable intellectual property legislation, without express permission of the respective owners.

8.3 Material published on the internet is protected by the same laws of copyright which apply to books, videos and music.

8.4 Unless expressly stated otherwise, you are not permitted to copy or republish anything you find on the internet without the copyright owner’s permission.

8.5 If you wish to refer to material on someone else’s website, you should acknowledge that website as the source or your comment and provide a link to that site.

8.6 Under Australian copyright law, limited quotation is allowed in the context of genuine review and criticism. However this does not permit extensive quoting of content. For further information, please refer to the Copyright Act 1968 (Cth).

8.7 When you submit content to the NCFH website, in any format, including photos and recipes, you acknowledge that you have all necessary rights, including copyright, in the material that you are contributing to our website. You agree that NCFH may use the material online and in whatever other ways we choose, now and in the future.

 

  1. Really simple syndication (RSS)

9.1 NCFH offer RSS feeds and widgets that allow you, on a non-exclusive basis, to display on your website or digital device, the information and/or material that you select to receive via RSS from www.farmerhealth.org.au. All intellectual property rights in the material received through the RSS feed remain NCFH property.

9.2 You do not need to obtain permission to use the NCFH RSS feeds or widgets, provided you comply with these terms.

10.1 Users should be aware that the World Wide Web is an insecure public network that gives rise to a potential risk that a user’s transactions are being viewed, intercepted or modified by third parties or that files which the user downloads may contain computer viruses or other defects.

10.2 NCFH accept no liability for any interference with or damage to a user’s computer system, software or data occurring in connection with the NCFH website or any linked website.

10.3 You acknowledge and agree that you must take your own precautions to ensure that the process which you use to access the NCFH website does not expose you to the risk of viruses or other form of interference that may damage your own computer system.

11.1 NCFH do not warrant that NCFH, or any content on the NCFH website, will be available uninterrupted or error free.

11.2 NCFH will not be liable for any corruption or failed transmission of any information that is attributable to your computer system or to the system of, or any act or omission of, your internet service provider (ISP).

11.3 You will ensure that the information you provide to NCFH does not contain any viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines that may damage, adversely interfere with, surreptitiously intercept or expropriate any system or data.

11.4 You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the NCFH website.
